Terms & Conditions

Please read these Terms carefully before using the Nexpert Institute website or enrolling in any course.

By accessing or using any part of the Website, or by submitting your details on it, you agree that you have read, understood and are bound by these Terms. If you don't agree, please stop using the Website.

1. Introduction

These Terms & Conditions ("Terms") govern your use of nexpertinstitute.com, together with its school sites sports.nexpertinstitute.com (Nexpert School of Sports & Fitness) and digitalmarketing.nexpertinstitute.com (Nexpert School of Digital Marketing & AI), and any related pages or services run by Nexpert Institute (together, the "Website").

"Nexpert", "we", "our" or "us" means Nexpert Institute, and "you" or "user" means any visitor, student or user of the Website. nexpertinstitute.com and its school sites share common ownership and infrastructure. These Terms apply the same way across all of them, unless a specific course page says otherwise. For how we handle your data, see our Privacy Policy.

2. Our Schools

Nexpert Institute runs two schools:

  • Nexpert School of Sports & Fitness (sports.nexpertinstitute.com), offering the Bachelor of Sports Management (BSM) and related courses in sports business, management and analytics.
  • Nexpert School of Digital Marketing & AI (digitalmarketing.nexpertinstitute.com), offering the Bachelor of Digital Marketing & AI (BDMAI), (CDMAI) and related courses.

Courses may run online, offline or in a blended format, and may include live sessions, recorded content, assignments, mentorship, industry projects and placement assistance, as described on the relevant course page.

3. Eligibility

You must be at least 18 years old and capable of entering a legally binding contract under the Indian Contract Act, 1872, to use the Website. Users between 15 and 18 may browse the Website and enroll only with the consent and supervision of a parent or legal guardian, who must accept these Terms on the user's behalf. We may ask for proof of age or guardian consent at any stage.

4. Account, Registration and Security

Some features, such as enrolling in a course, downloading a brochure, booking a counselling session or accessing student resources on either school site, require you to register. You agree to:

  • Give accurate, current and complete information at registration
  • Keep your login details confidential
  • Tell us right away if someone uses your account without permission
  • Take responsibility for all activity under your account

We are not liable for loss or damage caused by you failing to protect your login details.

5. Consent to Communication

By submitting your details on the Website, you give Nexpert Institute explicit consent to contact you through:

  • Phone calls
  • SMS
  • Email
  • WhatsApp or similar platforms

This may include responses to your enquiry, course updates and promotional communication. This consent applies even if your number is registered under DND or NDNC, in line with applicable law.

6. Course Fees and Payment Terms

Course and programme fees are shown on the relevant school page at the time of enrollment, in Indian Rupees unless stated otherwise. Fees may change at Nexpert's discretion. The fee that applies is the one shown when you enroll. Payments are processed through third-party payment gateways and, once made, are final, except as covered under a separate refund or cancellation policy, if published. Nexpert may withdraw, change, reschedule or discontinue a course or batch, and will make reasonable efforts to notify enrolled students.

7. User Representations

By registering, you confirm that all information you give us, including for enrollment on either school site, is accurate, current and complete, and that you are enrolling for your own personal or professional learning, not for resale or unauthorized redistribution of course content.

8. Unauthorized or Fraudulent Use

Trying to get around eligibility rules, misusing promotional offers, sharing paid course access or credentials with people who haven't enrolled, or any other fraudulent activity on the Website, is a breach of these Terms. You will be responsible for any resulting loss, and we may suspend or end your access.

9. User Conduct

You agree not to:

  • Copy, reproduce, distribute, sell or create derivative works from any part of the Website, including course content, videos, study material, logos and design, without written permission
  • Upload or share anything abusive, defamatory, obscene, infringing or otherwise unlawful
  • Introduce viruses, malware or code meant to disrupt or damage the Website or its users
  • Try to gain unauthorized access to any part of the Website, another user's account or our systems
  • Use the Website, or any content from it, in a way that breaks Indian law

We are not liable for loss arising from events beyond our reasonable control, such as technical outages, government action or anything else affecting the availability of the Website.

10. Course Content and Intellectual Property

All content on the Website, including course material, videos, presentations, logos, trademarks, graphics, text and software, belongs to Nexpert Institute or its licensors. Enrolling in a course gives you a limited, non-transferable license to use the material for your own learning, not to resell, publicly share or create derivative works from it without our written consent.

If you believe content on the Website infringes your intellectual property rights, email us at enquiries@nexpertinstitute.com with details of the claim, your contact information and a good-faith statement of the issue.

11. Links to Third-Party Sites

The Website may link to third-party sites, payment processors or services, for convenience. We don't control these sites and aren't responsible for their content, policies or practices. A link doesn't mean we endorse the site.

12. Disclaimer

We make reasonable efforts to keep information on the Website accurate, including course descriptions, placement statistics and industry-partner claims. However, we don't guarantee the Website will be uninterrupted or error-free, and we're not liable for outcomes such as job placement, salary or career progression, which depend on factors beyond our control. Placement assistance, where offered, is support we provide, not a guarantee of employment.

13. Limitation of Liability

We are not liable for:

  • Website interruptions or errors
  • Misuse of the Website by users
  • Indirect or consequential damages

14. Reviews, Testimonials and Feedback

Any reviews, testimonials or feedback you give us, on the main site or either school site, may be used by Nexpert for marketing, including your name, unless you ask us not to. Please don't submit anything false, defamatory or unlawful.

15. Termination

We may suspend or end your access to the Website, or to any course, without prior notice, if you break these Terms. You remain responsible for fees due for any course or service you've already used.

16. Changes to These Terms

We may revise these Terms from time to time. Updates take effect once posted here, and apply across the main site and both school sites. Continuing to use the Website after a change means you accept it.

17. Indemnification

You agree to cover Nexpert Institute, its staff and partners for any claims, losses or costs, including reasonable legal fees, that arise from your use of the Website, your breach of these Terms, or your violation of someone else's rights.

18. Severability

If any part of these Terms is found unlawful or unenforceable, the rest will continue to apply.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any disputes are subject to the exclusive jurisdiction of the courts in Thane, Maharashtra.
